J.K. Simms to Argue Before Sixth Circuit

On November 30, 2011, J.K. Simms, a partner of Cornelius & Collins, LLP, will argue before an en banc panel of the Sixth Circuit Court of Appeals. J.K. will appear before a full court of seventeen (17) judges on behalf of the Defendant-Appellee, Humboldt Acquisition Corp., in the case of Lewis v. Humboldt Aquisition Corp.
J.K., along with associate attorney J. Cole Dowsley, previously argued and secured a defense verdict in this matter before a jury in the United States District Court for the Western District of Tennessee. This defense verdict was affirmed by the Sixth Circuit Court of Appeals; however, the Court granted Plaintiff-Appellant's subsequent en banc request to consider whether, under the Americans with Disabilities Act, a plaintiff in an employment discrimiantion action must prove that his or her disability was the "sole cause" of an adverse employment action. The ultimate decision by the en banc panel will either reaffirm or overturn decades long precedent in the Sixth Circuit.
